1. Scope & Contractual Partner

These Terms and Conditions govern the use of the DuoLivo platform (website and apps) of SWARETIQ GmbH, Basel, Switzerland (“DuoLivo”/“we”). The contract language is German.

2. DuoLivo Services

  1. DuoLivo is an online dating service focusing on singles 50+. Functions: profile, search/matching, communication (e.g., messages and, if applicable, media/voice/video functions). A successful match is not guaranteed.
  2. Moderation & Protection: To secure the platform, we employ technical and organizational measures, including automated detection systems (also AI-supported) and manual checks, to detect and prevent spam, harassment, fraud, and violations of the Terms and Conditions/Community Guidelines, among other things.
  3. Storage & Retention: DuoLivo provides reasonable storage for messages/profile data. Content and log data may be stored for a limited period for security, abuse, and verification reasons and then deleted or anonymized (details in the privacy policy).
  4. Algorithmic Recommendations: DuoLivo uses algorithmic methods to display profile/match recommendations and sortings to increase relevance and user experience.
  5. No Coaching: Personal consultations on partnerships are not guaranteed.

3. Registration, Target Group & Conclusion of Contract

  1. Participation from 18 years. DuoLivo is primarily aimed at 50+. DuoLivo may remove/block profiles if age information is obviously incorrect or if there is improper use.
  2. Use requires a paid subscription (term 3/12 months).
  3. Order steps (web/app): Subscription selection → Payment method → Order overview/error correction → “Buy now”.
  4. Conclusion of contract: The contract is concluded upon receipt of the order confirmation. Access to all functions may – depending on the payment method – only take place after receipt of payment. The term begins with receipt of the order confirmation, unless otherwise stated in the checkout.
  5. For purchases via the Apple App Store or Google Play, the respective store conditions take precedence for conclusion of contract, cancellation, revocation and refund.

4. Subscriptions, Prices, Renewal & Cancellation

  1. DuoLivo offers paid subscriptions with a term of 3/6/12 months. Prices in CHF incl. VAT, transparently displayed in web/app (promo/special prices may apply for a limited time; the regular price applies thereafter).
  2. Automatic renewal: The subscription is extended by the originally selected term if it is not cancelled via the user account or – for in-app purchases – in the respective store at least 48 hours before expiry.
  3. Effect of cancellation: Cancellation can be declared at any time, but always takes effect at the end of the current subscription period. An early termination or pro rata refund during the current period is excluded. This rule applies accordingly after a renewal.
  4. Account closure/uninstallation: Closing the account or uninstalling the app does not replace a cancellation, does not pause the term and does not prevent renewal.
  5. DuoLivo can ordinarily cancel subscriptions at the end of the term or a renewal period with 1 month’s notice.
  6. Deviations for in-app subscriptions are governed by Apple/Google.

5. Payment

  1. The fee is due in advance for the entire term.
  2. Permissible payment methods are shown in the checkout.
  3. Returned debits/chargebacks may lead to blocking until the outstanding amount has been settled.

6. Obligations of Users & Community Rules

  1. Users are solely responsible for their profile and content; information must be truthful, up-to-date and personal.
  2. The following are prohibited, among other things: Violations of rights (personal, copyright, trademark rights), harassment, hate speech, pornographic/sexually explicit content, glorification of violence, political or commercial use, spam/mass messages, attempted fraud (e.g. demands for money), identity/age deception, scraping/bots, multiple accounts, disclosure of confidential messages/personal data without consent.
  3. Login data must be kept secret. Suspected misuse must be reported to us immediately.
  4. Violations may lead to blocking, deletion and/or extraordinary termination; legal action remains reserved. Details are governed by our Community Guidelines.

7. Child Safety Standards

  1. Only for adults (18+)
    DuoLivo is aimed exclusively at persons of legal age. Minors are not allowed to use the platform. We reserve the right to block or delete accounts if there is reasonable doubt about the age of majority.
  2. Zero tolerance for child endangerment/CSAE
    Content or behaviors that endanger, sexualize or exploit children (including “grooming”, initiation, requesting/disseminating sexualized depictions of minors, even seemingly fictitious/animated depictions) are strictly prohibited and will result in immediate removal/blocking of the account; legal action remains reserved.
  3. Reporting suspected cases (in-app & directly)
    Users can report suspected cases in the app via the report button (category “Child endangerment/CSAE”). Alternatively, our contact form and the e-mail support@duolivo.com are available. Reports in this category are given priority.
  4. Review, enforcement & cooperation with authorities
    In the event of concrete suspicion, we will remove the content in question immediately, block accounts and – to the extent required by law – cooperate with the competent authorities. Relevant measures are documented and stored in accordance with legal requirements.
  5. Data of minors
    We do not collect or process any personal data from children. If DuoLivo becomes aware of a minor account, the account and associated data will be blocked or deleted immediately.

8. User Content & Rights

  1. You warrant that you have all necessary rights to uploaded content.
  2. You grant DuoLivo a simple, worldwide, free license limited to the term of the contract to store, technically reproduce, make publicly accessible and edit content (e.g. thumbnails/compression) for the operation of the service.
  3. The license ends with account deletion; statutory retention obligations, backups and evidence (e.g. in the event of legal disputes) remain unaffected.

9. Availability

We strive for trouble-free operation, but do not guarantee availability at all times. Maintenance can be carried out at any time; we will announce planned work whenever possible.

10. Liability

  1. DuoLivo is liable for intent and gross negligence. For slight negligence, we are only liable for breach of essential contractual obligations (cardinal obligations), then limited to the foreseeable, typical damage at the time of conclusion of the contract.
  2. We are not liable for incorrect information or behavior of other users.
  3. Force majeure and internet/network disruptions for which we are not responsible exclude liability.

12. Data Protection

Our data protection declaration applies (including the use of analysis tools such as Google Analytics, moderation/fraud prevention measures, storage periods, rights of data subjects).

13. Contract Text & Storage

These terms and conditions can be viewed, saved, and printed in the web/app. DuoLivo does not separately store the individual contract text.

14. Changes to Terms and Conditions / Services / Prices

  1. We will notify you of significant changes (type, scope, duration/termination) 30 days before they take effect via email; until then, there is a special right of termination. We expressly point out the consent fiction in the event of silence.
  2. Service adjustments for good cause (legal/technical changes, upstream providers) are permitted, provided that there is no significant disadvantage.
  3. Price adjustments to pass on increased costs/taxes are permitted; we will inform you 30 days in advance with a special right of termination.

15. Final Provisions & Online Dispute Resolution

  1. Partial invalidity does not affect the validity of the remaining provisions.
  2. Applicable law/jurisdiction: Swiss law; jurisdiction Basel, Switzerland (mandatory consumer protection regulations of foreign legal systems remain unaffected).
  3. EU users (Note): The EU Commission’s ODR platform can be accessed at http://ec.europa.eu/odr. DuoLivo is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
  4. Contract language
    These terms and conditions are written in German and are legally binding. Translations into other languages are for information and understanding only. In the event of deviations or contradictions, the German version alone is authoritative.
